Grammy-winning singer Chris Brown has avoided immediate jail time in the UK after being sentenced to eight months in prison, suspended for one year, for attacking music producer Abraham Diaw with a tequila bottle at a London nightclub in February 2023.The 37-year-old singer had faced up to three years in prison after pleading guilty to one count of affray in July. The incident took place on the dance floor of Tape, a private club in the upscale Mayfair neighbourhood of London.During Monday’s sentencing at Southwark Crown Court, Judge Tony Baumgartner addressed the seriousness of the attack and made clear that celebrity status would not entitle Brown to special treatment.Video footage played in court showed Brown striking Diaw twice on the head with a bottle before being pulled away from him.“The repeated use of a glass bottle in that way, especially aimed at the head, was plainly dangerous, it carried the risk of delivering a more serious injury than was ultimately sustained,” the judge said, according to The Associated Press.
Why Chris Brown avoided immediate jail time
Despite the seriousness of the incident, the judge decided that a custodial sentence was not necessary. Brown’s guilty plea and several mitigating factors, including his stable employment and charity work, were taken into account. The judge also acknowledged Brown’s previous convictions but noted that he had maintained a clean record in recent years. As part of the plea agreement, prosecutors dropped charges of assault, attempting to cause grievous bodily harm and possessing an offensive weapon, referring to the bottle used in the attack.Brown’s friend and vocal coach, Omololu Akinlolu, who also pleaded guilty to affray, received a four-month suspended prison sentence.Affray is a criminal offence involving the use or threat of unlawful violence that causes another person to fear for their safety.
Prosecutors say Chris Brown played a leading role in the attack
Prosecutor Heidi Stonecliffe told the court that Brown had played a leading role in the incident, arguing that the video footage showed him initiating the violence.“By any circumstances, when one watches that footage, it is Mr. Brown that moves first,” Stonecliffe said.Diaw was discharged from hospital after sustaining injuries to his head and knee, the prosecutor told the court.Brown’s defence lawyer, Sallie Bennett-Jenkins, said the singer had apologised to those present at the nightclub. She also emphasised that the incident lasted no more than 20 seconds.“This is an ugly and unattractive incident,” Bennett-Jenkins said. “It is something which undoubtedly would have caused distress to those who are present and for which Mr. Brown … offers a profound apology to all those present.”
