Jan Suraaj petitions council chief to disqualify Independent MLCs
Jan Suraaj delegation meets legislative council chairperson Rambachan Roy, in Patna on Monday

Patna: Prashant Kishor-led Jan Suraaj on Monday formally petitioned legislative council chairperson Rambachan Roy, seeking immediate disqualification of newly elected MLCs Bansidhar Brajwasi and Rahul Raj.The party delegation, including former legislators Kishor Kumar Munna and Rambali Singh Chandravanshi, contended that the duo violated Article 191 of the Constitution and the Tenth Schedule (Anti-Defection Law) by allegedly switching allegiances to BJP within 72 hours of their election. Brajwasi and Raj secured victories from the Tirhut graduates’ and Saran teachers’ seats, respectively, running as independents and defeating candidates from the JD(U).The petition includes affidavits certifying their independent status alongside photographic and video evidence of their induction ceremony at the BJP office. “We have appended to our petition the affidavits filed by both MLCs which clearly stated that they contested the elections as Independent candidates, and the video footage and media reports related to their induction into the BJP,” Munna said. While BJP and the MLCs later backtracked under political pressure—claiming they merely extended support to the ruling party—Jan Suraaj remains resolute. The opposition RJD has also demanded their termination. Jan Suraaj functionaries warned that if the council chairperson failed to rule on the matter within the Supreme Court-mandated three-month window, they would escalate the legal battle directly to the apex court.
