Rera makes on-site inspection must for project extension requests in Noida, Ghaziabad and Lucknow

Ghaziabad: For builders seeking extension of projects, UP Rera has now made on-site inspection and verification of projects by its own expert team mandatory. The real estate agency said the amendment to Section 6 of UP Rera Act 2016 is in effect as of Oct 3.According to officials, the new rule will be applicable to projects based or registered only in Ghaziabad, GB Nagar and Lucknow. In all other UP districts, the task of conducting physical verification will be on the respective development authorities.Section 6 of Real Estate (Regulation And Development) Act, 2016 deals with the grant of extension of projects due to ‘force majeure’ — on account of war, flood, drought, fire, cyclone, earthquake or any other calamity caused by nature affecting the regular development of the project.Under the old system, applying for an extension required documents like inspection report and OC/CC verification, which were provided by the development authority after the promoter uploaded them on the UP Rera portal. The extension would be granted on the basis of this process. When asked what prompted the agency to make this amendment, an official said that they received a complaint by a Ghaziabad homebuyer on Sept 18 this year alleging that such documents were being manufactured due to collusion with development authorities and developers.“The complainant had suggested that UP Rera carry out inspection of the projects seeking extension by its own technical team rather than being dependent on promoters or respective development authorities. The suggestion had merit and in the larger interest of homebuyers it was adopted by UP Rera which came into effect from Oct 3,” the official added.Since most project extension requests come from developers from Ghaziabad, GB Nagar and Lucknow, UP Rera decided to make physical verifications mandatory by its own technical team only in these three districts. Before physical inspection, the developers will be informed in advance, the official said.
